Sales Terms and Conditions of PC & Informatica srl (ATPM)

1. Preamble and Definitions

This contract defines the terms and conditions between PC & Informatica srl and its customers for orders placed through the website www.atpm.it or by phone.

1.1 Definitions

The following are some terminological definitions, along with the relevant legal references for interpreting this contract:

• Consumer: A natural person who acts and enters into contracts for purposes unrelated to their business, commercial, craft, or professional activity.

• Professional: A natural or legal person acting in the exercise of their professional activity.

• B2C: Transactions between the Seller and the Consumer.

• B2B: Transactions with professional entities (not consumers).

• Right of Withdrawal: The Consumer’s right to unilaterally terminate the contract within the limits and according to the procedures established by current legislation.

2. Object of the Contract

This document regulates the general terms and conditions applicable to the sale of products by ##companyname##, both through the website www.atpm.it and via phone orders. All sales are governed by the conditions outlined in this contract, unless otherwise agreed in writing between the parties.

2.1 Customer’s Preliminary Check

The Customer is advised to carefully verify the correctness and compliance of the order with their needs before confirming the purchase, paying particular attention to:

• Technical specifications and compatibility of the product with any other items already owned;

• Product codes and descriptions listed on the website or communicated during the phone order;

• Any notes or warnings published by PC & Informatica srl or the respective manufacturers regarding the use, maintenance, and compatibility of the products.

The Customer's confirmation of the order implies acceptance of the technical specifications and the conditions described in this contract. PC & Informatica srl cannot be held responsible for errors or omissions made by the Customer during the verification and confirmation of the purchase.

3. Received Orders

Orders placed on the website are bound by the article codes specifically for Spare Parts and Consumables, which are sold exactly as described by the respective manufacturers on their official websites and identified with the original codes provided by them.

3.1 Acceptance

Orders will be considered accepted and processed only after the Customer’s payment is completed. PC & Informatica srl reserves the right to cancel all or part of an order, at its sole discretion, in the following cases:

1. Merchandise not available in stock or no longer available from suppliers;
2. Technical or logistical issues beyond ##companyname##’s control.
3. In these cases, the Customer will be promptly informed to agree on an alternative solution or refund.

3.2 Shipping

• Items available in stock will be shipped the same day for orders received by 1:00 PM.

• Out-of-stock items will be subject to procurement verification from suppliers; delivery times depend on availability.

• Partial shipments will only be made with the Customer’s authorization. Any additional costs for subsequent shipments, unless otherwise agreed in writing, will be borne by the Customer.

• Any delays outside of PC & Informatica srl's control will not entitle the Customer to disputes or claims for compensation.

4. Order Cancellation

The Customer can cancel the order in full or in part, except in the following cases:

• The order has already been shipped (only the remaining shipment can be canceled);

• The order is in the procurement phase (items already ordered from suppliers and no longer cancelable).

5. Right of Withdrawal

The right of withdrawal applies to all items sold on the website atpm.it. Some exclusions may apply, and in this case, the Customer will be informed before the order is accepted.

5.1 Scope of Application

• Exclusively applicable to consumers (B2C).

• Excluded for businesses, resellers, or holders of VAT numbers (B2B).

5.2 Exercise of the Right

• The Consumer may withdraw within 14 working days from the receipt of the goods by notifying it by email to support@atpm.it.

5.3 Return of Goods

• Goods must be returned in their original packaging and in new, unused condition.

• Return shipping is at the Customer’s expense.

6. Returns and Refunds

Returns are possible both for withdrawal and for other reasons, as summarized below.

6.1 Acceptable Reasons for Return (Other than Withdrawal)

• Customer Errors: Products that are unused and intact must be reported within the day following delivery. The return shipping costs, both for the initial shipment and the return, are entirely at the Customer’s expense. A refund will be issued via a coupon of equal value.

• Shipping Errors: PC & Informatica srl will cover the return shipping costs.

• Defective/Damaged Products: Management of these cases is governed by the warranty provisions in Section 9 of this contract.

6.2 Return Procedure

The Customer must request a return authorization by contacting Customer Service and providing:

1. Order number and Customer details;
2. Description of the issue or reason for the return;
3. Photographs or other necessary documentation (for damaged or defective items).

6.3 Refund Timing and Procedure

• Refunds will be processed within 14 working days from receipt of the returned goods.

• For Customer errors, the refund will be equal to the value of the product, excluding shipping costs.

7. Limitation of Liability

PC & Informatica srl shall not be liable in the following cases:

• Information provided on the website that is based solely on statements from the respective manufacturers;

• Incompatibility with other product codes, also based on official information from the manufacturers;

• Any incompatibilities noticed at the time of use;

• Compatibility between products requiring the purchase of additional items or knowledge of technical specifications not communicated by the manufacturers or not known to ##companyname##;

• Damage or malfunctions resulting from improper use of purchased goods;

• Technical or compatibility errors related to third-party products, based on the specifications provided by the manufacturers;

• Errors or omissions made by the Customer during the order process;

• Damage or malfunctions caused by repair or maintenance work performed by unqualified technicians.

In accordance with Articles 1218 and 1229 of the Civil Code, PC & Informatica srl will be exempt from any liability for direct or indirect damages arising from purchases made via the website www.atpm.it, within the limits prescribed by law. In these cases, the Customer expressly relieves PC & Informatica srl from any liability for damages or indemnifications, even to third parties.

10. Final Provisions

These terms and conditions are subject to the applicable Italian laws and do not limit any mandatory consumer rights. For any disputes, which cannot be resolved through arbitration, the competent court is the Court of Fermo.
